1. General remarks
Klinikal (which will be referred to “we,” “us,” or “our” in the further text) has created this Privacy Policy to demonstrate our firm commitment to keeping data privacy of individuals (who will be referred as “you” or “your” in the further text), who use our services. We respect your data privacy, and have therefore taken all precautions to create a process that keeps your Personal Information safe to a maximal possible extent.
This Privacy Policy will help you understand how your Personal Information is collected on our website or mobile app, how it is kept secure, how we use it, and under which condition it may be disclosed/shared with third parties. This Privacy Policy also describes the choices available to you regarding our use of your Personal Information, and how you can access, update and delete this information.

In addition, we may change the Privacy Policy from time to time, and post the new version on this page, with the corresponding date. We therefore encourage you to review it periodically, to stay informed about the changes in our Privacy Policy. If you disagree with any changes, you will need to stop using the website or app, and deactivate your account.
WE TAKE ALL PRECAUTIONS IN AN EFFORT TO PROTECT YOUR PERSONAL INFORMATION AGAINST SECURITY BREACHES. HOWEVER, THERE IS NOT A GUARANTEE THAT SUCH INFORMATION MAY NOT BE ACCESSED, DISCLOSED, ALTERED, OR DESTROYED BY BREACH OF FIREWALLS AND SECURE SERVER SOFTWARE. BY USING OUR WEBSITE AND MOBILE APP, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO ASSUME THESE RISKS.
Our services are not directed to individuals under 16 (“child”). We do not knowingly collect personal information from children. If we become aware that a child has provided us with personal information, we will take steps to delete such information. If you become aware that a child has provided us with personal information, please contact us. Any information entered on behalf of a child must be strictly provided by a parent, legal guardian or recognized next-of-kin. The same is valid for individuals without the intellectual or physical capacity to provide informed consent for using our services.
2. What information do we collect from you, and how?
We collect information about you: a) when you provide it to us explicitly, and b) automatically when you use the website or mobile app. We limit the collection and processing of all information to what is necessary to fulfill the purposes for which the information is to be used.
a) We collect information about you when you register for an account, create or modify your profile or set preferences through the website or mobile app. We keep track of your preferences when you select available options. The personal information we collect from you includes: your name, email address, phone number, physical address, city, state/province, zip code/postal code, date of birth, gender, ethnicity, lifestyle, your health condition, diagnosis and therapy, and your clinical trial interests. We will ask you your preferences concerning the clinical trials, for example how far you are ready to travel to the clinical trial site. Some information may be mandatory, and some may be optional. All that information is referred to as “Personal Information”: this is information which identifies an individual, or can cause an individual to be identified.
b) We keep track of certain information about you when you visit and interact with our website and mobile app. This information includes the features you use, frequently used search terms, and how you interact with the website. We also collect information about your computer, phone, tablet, or other devices which you use to access the website. We collect information through your device about your operating system, browser type, IP address, location and URLs of referring/exit pages. Finally, we and our third-party partners, such as our advertising and analytics partners, use cookies and other tracking technologies (e.g., web beacons, device identifiers and pixels) to provide functionality and to recognize you across different websites and devices. Those third-party partners have access to all the information, but in the anonymous form: “Anonymous Information” means information which does not enable identification of an individual user, such as aggregated information about use of our services.
You can use your Internet Browser to disable cookies, although your experience using our website may be altered without using them. Also, some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the website you visit indicating you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the DNT signal, our website does not currently respond to browser DNT signals.
We may contact you from time to time, uniquely by email or within our mobile app, about clinical trials that might match your preferences, to offer new clinical trial opportunities, introduce new products and features, to share educational materials, to solicit participant stories after studies are completed, and for other reasons supporting our mission of helping you find and access appropriate clinical trials. We then may require from you to provide some new Personal Information, regarding new opportunities which could be of interest for you.
3. How do we keep and use the information collected from you?
We will use and store your Personal Information securely, on a secure cloud server, for the purpose of delivering our services, and to analyze and enhance our operation. We use information about you to verify your account and activity, to monitor suspicious or fraudulent activity and to identify violations of our policies.
We use data hosting service providers in the United States to host the information we collect, and we use technical measures to secure your data. While we implement safeguards designed to protect your information, no security system is impenetrable, and due to the inherent nature of the Internet we cannot guarantee that data, during transmission through the Internet or while stored on our systems or otherwise in our care, is absolutely safe from intrusion by others. Any detected breach of data security (accidental or unlawful access, disclosure or misuse of personally identifiable information) shall be reported without undue delay.
We use your Personal Information principally to be able to match you with available clinical trials. Each trial has its corresponding inclusion and exclusion criteria, so your Personal Information will be compared to them, in order to assess if the trial is a good match for you. Our website also includes tailored features that personalize your experience and improve your search results.
We are always looking for ways to make our website smarter, faster, secure, integrated and useful to you. We use collective learnings about how people use our website and mobile app and feedback provided directly to us to troubleshoot and to identify trends, usage, activity patterns and areas for integration and improvement of the website. We also test and analyze certain new features with some users (beta version) before rolling the feature out to all users.
When you register and provide your email address, we will send you administrative and promotional emails. If you wish to opt out of promotional emails, you may do so by following the “unsubscribe” instructions in the email, or by editing your account settings. On the other hand, all users receive administrative emails, and so you cannot opt out of them while you remain registered.
We may post user testimonials on our web site, and may use testimonials in other formats consistent with consent received. Testimonials may contain personally identifiable information. We may use your Personal Information to contact you to obtain a testimonial and obtain your consent via email or agreement sent via pdf or mail prior to using such testimonial and/or using your name along with your testimonial.
How long we keep information we collect about you, depends on the type of information. We will only retain your Personal Information for as long as it is needed for the purposes set out in this document or the law requires us to. After such time, we will either delete or anonymize your information or, if this is not possible (for example, because the information has been stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible.
We retain your account information until you delete your account. We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations and to continue to develop and improve our website. Where we retain information for website improvement and development, we take steps to eliminate information that directly identifies you, and we only use the information to uncover collective insights about the use of our website, not to specifically analyze personal characteristics about you.
We collect information globally and primarily store that information in the United States. We may transfer, process and store your information in other countries,, to wherever we or our third-party service providers operate for the purpose of providing you the website. Whenever we transfer your information, we take steps to protect it. Some of the third parties, which provide website to us under contract, are based in other countries that may not have equivalent privacy and data protection laws than those in the United States.
Finally, we are HIPAA compliant. The Health Insurance Portability and Accountability Act of 1996, commonly known as HIPAA, is a series of regulatory standards that outline the lawful use and disclosure of protected health information. In simpler words, HIPAA ensures that health information is safe and secure, by applying a mandated set of rules on how to record, store, manage and share a US citizen’s private and personal medical information.
4. Which information do we disclose to third parties, and to whom?
We share your Personal Information uniquely in the ways discussed below. We are not in the business of selling information about you to advertisers. We never share your information with any other users on our website.
We connect you with clinical trial coordinators, whose task is to organize clinical trials at clinical trial sites, and with any other partners involved in the clinical trial (such as doctors); we do not host or run any trials ourselves. This means that we share/disclose your Personal Information with certain third parties, according to our contract conditions with them. We therefore share information with third parties that run and operate clinical trials. These are the only third parties that we share your information with. By creating your profile, you automatically authorize us to share your information with the clinical trial coordinators and other partners involved in the clinical trial, in order to be able to verify if you satisfy the criteria for participation.
We require those third parties to protect Personal Information using substantially similar standards to those used by us. We also require that they do not use your Personal Information for any separate use that is not specifically related to the execution of the concrete clinical trial or as otherwise authorized by us.
We are obligated to report any adverse events to the clinical trial sponsor for regulatory compliance. In these cases, you are also accepting that the clinical trial sponsor may contact your doctor for further information about the adverse event. All information received by the sponsor is treated in confidence, and the patient information is de-identified. Adverse event reports may be forwarded to the relevant health authorities.
Our website may include social media features, such as the Facebook “Like” button and widgets, such as the “share this” button or interactive mini-programs that run on our site. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and widgets may be hosted by a third party or hosted directly on our sites and applications. Your interactions with these features are governed by the privacy policy of the company providing it.
We may share your Personal Information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information held by us about our website and customers is among the assets transferred.
Finally, there may also be instances where we may be required to share your Personal Information with third parties who have not been retained by us (directly or indirectly), as ordered or directed by courts of law or other governmental agencies.
5. How can you access and control your personal information?
If you would like the Personal Information associated with your account permanently removed from our database, please contact us by email. We will promptly delete your account information and you will no longer receive email from us.
Your removal from the account database will not remove records of past use, nor delete information stored in our data backups and archives. Such data will be maintained and/or deleted in the ordinary course of our business. We will take reasonable steps to protect against unauthorized access to or use of any personal information contained in records that are deleted from our system.
Where you have asked us to share your Personal Information with third parties (clinical trial coordinators), you will need to contact those third-party service providers directly to have your information deleted or otherwise restricted. If you have unresolved concerns, you may have the right to complain to a data protection authority in the country where you live or where you feel your rights were infringed.
You may opt out of receiving promotional communications from us by using the “unsubscribe” link within each email or by contacting us to have your contact information removed from our promotional email list or registration database. Even after you opt out from receiving promotional messages from us, you will continue to receive transactional messages from us regarding our website.
If you wish to make a complaint about the way we have handled your personal information, you can contact us via email. Please include your name, email address and/or telephone number and clearly state your arguments. We will acknowledge your complaint and respond to you within a reasonable period of time. If you think that we have failed to resolve the complaint satisfactorily, we will provide you with information about the further steps you can take.
California Online Privacy Protection Act Notice
At your request, we will limit the processing of your personal data if any of the conditions from Article 31 of the Law on the Protection of Personal Data are met (eg if you have a well-founded dispute about the accuracy of your personal data or the legality of the processing, etc.)
1. We do not track users who do not interact with our sharing functionality across the web, and therefore do not use “do not track” signals.
2. We do not authorize the collection of personally identifiable information from our users for third party use through advertising technologies without separate member consent.
California Civil Code Section 1798.83 also permits our customers who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to support@trialjectory.com. Please note that we are only required to respond to one request per customer each year.
European Union (EU) GDPR
In accordance with the GDPR (General Data Protection Regulation) 2016/679, citizens of the EU may access, rectify, update or delete/withdraw their personal information by sending an e-mail to our European Representative DataRep: datarequest@datarep.com.
We may require you to provide additional information necessary to confirm your identity before we comply with any request made by you.
